On Atlanta 5 Fox News last night, Nancy Benoit's family attorney, Richard Decker, was a guest on the program. He said that the family was relieved that Daniel was not conscious when he died. When the reporter brought up the fact that the Benoit family would be filing a wrongful death lawsuit, Decker said that he'd "rather not speculate" on who the defendants will be. "Eventually we'll be filing a lawsuit and everyone will know," said Decker.
